This DMCA Takedown Policy is specifically designed to address infringing content posted on agoratv.co. 

DMCA Notice & Takedown Policy and Procedures

We respect the intellectual property rights of copyright holders and choose to comply voluntarily with the Notice and Takedown provisions of the Digital Millennium Copyright Act ("DMCA"). Our Site is recognized as a "Service Provider" under 17 U.S.C. § 512(k)(1) of the DMCA, granting us certain protections from copyright infringement claims under the DMCA's "safe harbor" provisions. We uphold the intellectual property rights of others and expect our users to do the same. As such, we adhere to the DMCA and have established the following Notice and Takedown Policy to address copyright infringement claims from our customers, subscribers, or users.

Notice of Claimed Infringement

If you believe that your work has been copied and posted on agoratv.co in a way that constitutes copyright infringement, please provide the following information to Our Designated Copyright Agent:

(a) The electronic or physical signature of the person authorized to act on behalf of the copyright or intellectual property owner;

(b) A description of the copyrighted work or intellectual property you claim has been infringed;

(c) A description of where the allegedly infringing material is located on the Site (preferably including specific URLs);

(d) Your contact details: address, telephone number, and email address;

(e) A statement from you, in good faith, that the disputed use is unauthorized by the copyright owner, its agent, or the law;

(f) A statement from you, under penalty of perjury, that the information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on their behalf.

Abuse Notification

Abusing the DMCA Notice procedures or misrepresenting facts in a DMCA Notice or Counter-notification can result in legal liability for damages, court costs, and attorneys' fees under federal law (see 17 U.S.C. § 512(f)). These procedures apply only to copyright infringement claims – not to other types of abuse, infringement, or legal claims. We will investigate and take action against anyone abusing the DMCA notification or counter-notification process. Ensure you meet all legal qualifications before submitting a DMCA Notice to our Designated Agent.

Take Down Procedure

Upon receiving a notification of claimed copyright infringement, the Site implements a "notification and takedown" procedure. We reserve the right to disable access to or remove any material or activity on the Site or any materials claimed to be infringing, based on facts or circumstances indicating infringing activity. Our strict policy is to terminate the accounts of repeat copyright infringers when appropriate. We will promptly remove access to all material that infringes on another's copyright, following the procedure in 17 U.S.C. §512 of the DMCA. If a Notice does not comply with §512 of the DMCA but meets three criteria for identifying infringing sites according to §512 of the DMCA, we will attempt to contact the complainant to assist them in complying with the notification requirements. When our Designated Agent receives a valid Notice, we will quickly remove or disable access to the infringing material and notify the affected user. The affected user can then submit a counter-notification to the Designated Agent, asserting under penalty of perjury that the material was removed due to misidentification. After receiving a counter-notification, the Designated Agent will restore the material within 10-14 days unless we receive notice that a court action has been filed by the complainant seeking an injunction against the infringing activity.

DMCA Counter-Notification Procedure

If an individual who has received a Notice of Claimed Infringement believes the notice is incorrect or false, or that the material alleged to be infringing was improperly removed, they have the right to submit a counter-notification under Section 512(g)(2) & (3) of the DMCA. A counter-notification serves as a formal dispute against the removal or disabling of material based on a Notice. The individual submitting the counter-notification must ensure that the information provided is accurate and truthful, as they will be held responsible for any false statements that result in legal claims against the Site arising from actions taken in response to the counter-notification.

To submit a counter-notification, the following information must be provided to Our Designated Copyright Agent:

(a) A detailed description of the material that was removed or disabled due to the Notice;

(b) The location within the Site or content where the material was situated before its removal or disabling (including specific URLs, if possible);

(c) A statement asserting the individual's belief that the removal or disabling was incorrect, using the following format for convenience: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled by the service provider due to a mistake or misidentification of the material.";

(d) The individual's physical address, telephone number, and email address; and

(e) A statement indicating that the individual consents to the jurisdiction of the Federal District Court for their judicial district, or if outside the United States, for any judicial district in which the service provider may be located, and that the individual will accept service of process from the person who provided the Notice or their agent.

All DMCA notices and counter-notifications must be submitted in English. Notifications in foreign languages or using foreign characters will be deemed non-compliant and ignored.

Upon receiving a DMCA-compliant counter-notification, Our Designated Copyright Agent will forward it to us, and we will then provide it to the claimant who initially sent the original Notice identifying the allegedly infringing content.

Subsequently, within 10-14 days of our receipt of a counter-notification, we will restore or cease disabling access to the contested material, provided that we or Our Designated Copyright Agent have not received notice that the original claimant has initiated legal action seeking a court order to prevent the individual from engaging in infringing activity related to the material on the Site's system or network.

Modifications to Policy

The Site reserves the right to modify, alter, or add to this policy, and all affected individuals should regularly check back to stay informed of any changes.

Customer service inquiries, payment questions, and cancellation requests will not receive a response. All such communications must be directed to the Site's customer service department.
